Prayer in the present petition is for quashing of summoning order dated 06.11.2008 (P-1) and subsequent order dated 01.07.2010 (P-2), whereby petitioner No.2 has been declared proclaimed offender.
Learned counsel for the petitioners submits that in pursuant to the order dated 08.03.2022, the payment of Rs.1.5 lac has already been deposited in the account of the complainant and the dispute has been amicably settled between the parties. He has placed on record relevant documents. He, thus, submitted that the present petition be accepted and all other subsequent proceedings be quashed.
Learned counsel for respondent No.1 does not dispute the above-said factual position and admits that a sum of Rs.1.5 lac has been received by respondent No.1.
Keeping in view of the above and the stand taken by learned counsel for respondent No.1, the present petition is accepted. The impugned order dated 06.11.2008 (P-1), order dated 01.07.2010 (P-2) and all other subsequent proceedings arising therefrom are quashed.
