Heard Sri.B.V.Pinto, learned counsel appearing for the petitioner and Sri. B.S.Prasad, the learned Special Public Prosecutor appearing for the respondent.

2. The petitioner is before this Court calling in question the proceedings in Spl.C.C.No.90/2005 pending on the file of LXXVIII Additional City Civil and Sessions Judge & Special Judge (PCA), Bengaluru City.

3. The learned counsel appearing for the petitioner would submit that the issue in the case at hand stands covered by the judgment rendered by this Court in NC: 2024:KHC:25125 Crl.P.No.3034/2024, disposed of on 25.06.2024, wherein this Court has held as follows:

ORDER

(i) The Criminal Petition is allowed; and

(ii) The proceedings in Spl.C.C.No.90/2005, pending before the LXXVIII Additional City Civil and Sessions Judge & Special Judge (PCA), Bengaluru City, stands quashed.
