7 "Heard the learned s senior counsel for the petitioner and the Government

; Pleader for Endowments. seeks time for filing counter and the office is directed
to print the name of the learned Standing Counsel for the 3 respondent.
: The grievance of the Writ Petitioners i is that the respondent Nos.2 and 3
vate contemplating: to implement the Memo in R.C.No.J1/699/2022, dated
30. 10.2022 issued by the 2nd respondent for the agreement entered into by the
. petitioners in the 3r respondent temple for the period of 01.04.2022 to
3. 03.2023, dated 30.08. 2022.
The learned senior. counsel for the petitioners submits that the petitioner
cis the lowest successful bidder for the executive works as mentioned in the
- 'said agreement, dated 30.08.2022 and same is being implemented for the
present. While so, 'the 279 respondent issued the impugned Memo 30.10.2022
enabling the Executive Authorities/Offi icers to act diligently to place the indent
for A.P. Markfed, before the existing. tenderer's period and duly entering a
'proforma Tripartite Agreement on the lines of TTD. The learned senior counsel
for the petitioners apprehends if this Memo is implemented to the case of the
petitioner also for the agreement, dated 30.08.2022 the same good get
frustrated as the Period of lease is subsisting up to 31.03.2023. Since the
Memo issued by the 2nd respondent is generally in nature it may have to be
ted. for Prospective purposes prima facie this Court feels that it may not be
applied for the contractors and agreement entered into by the 3 respondent
temple previously. However, to make it clear for the present as an interlocutory
relief this Court passes an, order to that effect that the Memo of the 2nd
respondent 30.10.2022 may not be applied within immediate effect to the
agreement entered. into by the petitioner with the 3" respondent, dated
30.08.2022 for a period of four (04) weeks from today.
