1. Heard learned Advocate for the Plaintiff. On the basis of the averments in the Plaint and the documents produced therewith, prima facie case is made out for arrest of Defendant No. 1 Vessel ALTUS UBER (IMO NO. 9385300). In view thereof, the Defendant No. 1 Vessel ALTUS UBER (IMO NO. 9385300) is ordered to be arrested. A separate order by way of Judges Order is signed /passed against the Defendant No. 1 Vessel.
2. Caveat Register book is produced. The Learned Advocate for the Plaintiff states that there is no Caveat Against Arrest of the Defendant No. 1 Vessel ALTUS UBER (IMO NO. 9385300), as on date.

3. The Registered Owners of the Defendant No. 1 Vessel, through its Advocates undertake that they shall, without prejudice to their rights and contentions and without admission of any liability whatsoever, deposit the sum of INR Rs.6,76,200/- by way of Demand Draft in favour of Prothonotary & Senior Master, High Court, Bombay as security towards release of the Defendant No. 1 Vessel, within 10 working days from the date of this order. The undertaking is accepted.
4. The Prothonotary & Senior Master to invest the amount in a fixed deposit with a nationalized bank initially for a period of one year and to be renewed year after year unless otherwise directed, until further orders.
5. Upon the Advocates for Defendant No. 1 Vessel handing over the Demand Draft of INR Rs.6,76,200/- to secure the claim in Commercial Admiralty Suit (L) No. 34 of 2019 to the Prothonotary & Senior Master, High Court, Bombay, this order of arrest shall stand vacated and the Defendant No. 1 Vessel ALTUS UBER (IMO NO. 9385300), shall forthwith stand released and free to sail.
