This writ petition has been filed challenging the impugned refusal check slip dated 03.10.2025 issued by the respondent refusing to register the sale deed dated 29.09.2025 presented by the petitioner for registration on the ground that the subject plot is an unapproved one.

2. The petitioner admits that the plot in question is an unapproved plot. However, the petitioner contends that in respect of other plots, the respondent had registered the sale deeds.

The learned Special Government Pleader appearing for the respondent would submit that since the date of presentation of the sale deed falls after the cut-off date, i.e., 20.10.2016, as stipulated under G.O.Ms.No.78, Housing and Urban Development [UD4(3)] Department, dated 04.05.2017, the regularisation of unapproved plot from the competent authority is mandatory. The said GO is also placed on record before this Court.

Since the aforesaid GO makes it clear that the cut-off date for registering the unapproved plot is on 20.10.2016, and since the sale deed presented by the petitioner for registration falls after the cut-off date, necessarily the petitioner will have to obtain regularisation from the competent authority and only thereafter, can get his sale deed registered. Therefore, this Court is of the considered view that there is no infirmity in the impugned refusal check slip issued by the respondent, and accordingly, this writ is disposed of by granting liberty to the petitioner to seek for regularisation of the unapproved plot before the competent authority and once the petitioner has obtained regularisation of the unapproved plot from the competent authority, the petitioner is permitted to present the sale deed once again for registration with the Registration __________ Page2 of 4 https://www.mhc.tn.gov.in/judis ( Uploaded on: 17/03/2026 12:01:51 pm ) Department, and the Registration Department shall entertain the same and register the document, if it is otherwise in order, on production of the regularisation order.
