4. It is submitted that Defendant no.4 has fulfilled all his obligations towards Defendant nos.1 and 2 and is facing considerable hardship and monetary loss due to dilatory tactics of the Plaintiffs".
If that is so, sole appellant cannot escape blame on the ground of conduct of champerty i.e. clandestinely entering in to illegal agreement with the litigant to aid or finance the litigation in return for a share of the proceeds following a successful outcome of the litigation.
