JUDGMENT
Petitioners seek a direction to the 3rd respondent to issue the K-TET-III Certificates after declaring them as duly qualified for issuance of such certificates.
2. Petitioners are B.Tech Graduates having B.Ed qualification. Aspiring to be school teachers, petitioners applied for attempting the K-TET-III Examination conducted by the 3 rd respondent and became successful. However, their certificates were not issued to them stating that B.Tech/ B.E.degrees are not amongst the essential qualifications required for K-TET-III. It is in such circumstances that petitioners have approached this Court seeking a direction as mentioned earlier.

The learned counsel for the petitioners submitted that an identical issue was raised by certain other persons in W.P.(C) No.14090 of 2024 who were also B.Tech Degree holders and by judgment dated 23.09.2024 produced as Ext.P1, the said writ petition was allowed and it was declared that the petitioners therein were entitled to get the K-TET Category-III Certificates. It was submitted that petitioners are situated in WP(C) NO. 45689 OF 2025 4 2026:KER:3435 an identical position as those writ petitioners.
4. The learned Government Pleader fairly submitted that no appeal was preferred against Ext.P1 judgment and that the petitioners stand on an identical situation provided the certificates produced by them are valid.

In Ext.P1 judgment, this Court had observed that in the Notification No.F.51-1/2014-NCTE (N&S) dated 28.11.2014 which was produced as Ext.P13 in that writ petition, it was provided that the graduates in Engineering or Technology with specialization in Sciences and Mathematics were eligible for pursuing the B.Ed degree course. It was further observed that the petitioners therein could not have been denied the opportunity to attend the K-TET-III Examination and obtain certificates if they had become qualified in that regard. The learned single Judge also observed that the provisions of Chapter-XXXI Rule 3 of KER would include a degree in B.Tech as a sufficient qualification for obtaining the K-TET III examination and thereafter found those writ petitioners to be eligible to obtain K-TET Category-III Certificates.

Having regard to the fact that petitioners are all B.Tech Degree Graduates situated in an identical position as that of the writ petitioners in W.P.(C) No.14090 of 2024, I am of the view that this writ petition also ought to be allowed and the petitioners be declared as WP(C) NO. 45689 OF 2025 5 2026:KER:3435 eligible to obtain the K-TET Category-III Certificate.
Accordingly, it is declared that petitioners are entitled to get the K-TET Category-III Certificates and the 3rd respondent is directed to issue such certificates to the petitioners subject to the marks scored by them in the said examination. The needful shall be done within an outer period of one month from the date of receipt of a copy of this judgment.
The writ petition is allowed as above.
