The law of the land commands that equally placed persons must be treated equally. Thus, the ground of parity cannot be ignored. As far as the question of pendency of two more cases of identical nature against the petitioner is concerned, it is noticed that both the cases pertain to offence under Section 29 of the NDPS Act and based on the information supplied by the co-accused, no incriminating material was recovered from the petitioner in that matter. Thus, viewing from any angle, this court is satisfied that the present is a fit case for bail. It is deemed appropriate to direct the petitioner to inform the SHO P.S. Nokha regarding his Global Positioning System (GPS) location regularly every month till disposal of the trial by sharing the Google PIN of his location with the SHO, PS Nokha.
