This petition under Section 482 of the Code of Criminal Procedure has been filed for quashing of FIR No.284 dated 23.10.2015, registered under Sections 420, 467, 468, 471 and 120-B of the Indian Penal Code (for short 'the IPC'), at Police Station Dakha, District Ludhiana, and all consequential proceedings arising therefrom, on the basis of compromise (Annexure P-2) arrived at between the parties.
Vide order dated 28.07.2016, the parties were directed to appear before the learned Chief Judicial Magistrate/Illaqa Magistrate, for getting their statements recorded. In compliance thereof, report of Judicial Magistrate 1st Class, Ludhiana, dated 09.09.2016, has been received, wherein, it has been noticed that "From the statements, it appears that compromise has been effected between the parties without any pressure and with their free will."
