In the light of the contentions of the parties, it is to be first noted that in a suit on the foot of a promissory note filed by the plaintiff, the defendant, having raised a contest that the suit promissory note is a rank forgery, had obviously obtained privately a report/opinion from a private expert of a private laboratory having ISO Certification and had filed these two petitions (one) to receive the said report/opinion of the private expert on file after granting leave and by condoning the delay; and (the other) to summon the said expert to prove the contents of his report/opinion. Both the petitions were dismissed by the Court below. In this backdrop, and the sets of contentions advanced by the learned counsel for the parties, it is necessary to refer to the relevant provision of law.
