the respondents to grant the service weightage and age
relaxation as directed by this Hon'ble Court in Morarji Dasai
Teachers' case in W.P.Nos.20204-20368/2011 & connected
matters disposed of on 13.7.12 & other cases. Further
petitioner has sought to forebear the respondents from giving
effect to the final list and after granting the service weightage
and age relaxation the list may kindly be operated.

:O R D E R:
The petitioners in these petitions are questioning the legality and validity of the impugned order dated 11.12.2012 passed by the Karnataka Administrative Tribunal, Bangalore, in application Nos. 5811- 6110/2011 vide Annexure-A, in so far as they are concerned and to modify the order by issuing a writ of mandamus directing the respondents to grant the service weightage and age relaxation as directed by this Hon'ble Court in Morarji Dasai Teachers' case in W.P.Nos.20204-20368/2011 & connected matters disposed of on 13.7.12 and other cases. Further petitioners have sought to forebear the respondents from giving effect to the final list and after granting the service weightage and age relaxation the list may kindly be operated.

In brief, the facts are, petitioners seeking direction to the respondents to regularize their services as they are working as against the sanctioned posts and 56 extend all benefits on par with that of Second Division Surveyors Grade-II and other prayers have approached the Karnataka Administrative Tribunal, Bangalore, in Application Nos. 5811-6110/2011. Those matters had come up for consideration before the Tribunal. The Tribunal, after hearing both sides and after considering the materials available on file, has disposed of those applications holding that if the applicants give a representation in this regard, the same shall be examined by Government so as to give some relief to them within the limits put by the Supreme Court in Umadev's case and the decisions of the High Court dated 13.7.2012 and if a representation is given in this regard to the Commissioner for Survey, Settlement and Land Records, he shall examine it and place it before the Government and the Government shall take a decision thereon as far as possible, within six months from the date of such representation is given and accordingly, disposed of those applications. Being 57 aggrieved by the order impugned passed by the Tribunal, the petitioners have presented these petitions.

The principal submission canvassed by the learned counsel for petitioners, at the outset is that, the Tribunal has failed to observe at the time of disposing of the application regarding granting the service weightage and age relaxation as directed by this Hon'ble Court in Morarji Dasai Teachers' case in W.P.Nos.20204-20368/2011 & connected matters disposed of on 13.7.12 and other cases and therefore, petitioners are constrained to approach this Court, so far as it relates to not observing regarding granting the service weightage and age relaxation. Therefore, he submitted that appropriate direction may be issued to the respondents that if representation is submitted by the petitioners the same may be considered after giving service weightage and age relaxation before forwarding his recommendation to the Government. 58

Per contra, learned Government Pleader appearing for respondents, inter-alia, submitted that the relief sought by the petitioners cannot be sustained and is liable to be dismissed as not maintainable. To substantiate the said submission, she pointed out that, in fact, the Tribunal has observed to give representation, but instead of giving representation to the Commissioner for Survey¸ Settlement and Land Records, petitioners have rushed before this Court by presenting these petitioners and therefore, interference by this Court is not called for since the relief sought by them is premature in nature.

After hearing the submissions made by learned counsel for the petitioners and after careful perusal of the order impugned passed by the Tribunal, it emerges that, Tribunal after due consideration of the material on record, the submissions made by learned counsel for both the parties and in view of the judgment of the Apex Court and this Court is justified in 59 observing that the suggestions made by the learned counsel for applicants is feasible or can be acted upon is a matter that has to be considered by the Government. Further the Tribunal has observed that if the applicants give a representation in this regard that shall be examined by Government so as to give some relief to them within the limits put by the Supreme Court in Umadevi's case and the decisions of the High Court. Further, the Tribunal has observed that, if a representation is given in this regard to the Commissioner for Survey, Settlement and Land records, he shall examine it and place it before the Government and the Government shall take a decision thereon as far as possible, within six months from the date such representation is given. Therefore, there is no impediment for the petitioners to give their consolidated representation to the Commissioner for Survey, Settlement and Land Records, requesting to consider their case and grant service weightage and age 60 relaxation as per the order passed by this Court in Morarji Desai Teachers' case in W.P.Nos.20204- 20368/2011 disposed of on 13.7.2012 and other orders passed by the Coordination Bench of this Court. If such representation is given by the petitioners to the Commissioner for Survey, Settlement and Land Records, he shall consider the same in accordance with law and submit his report to the Government.

Therefore, without expressing any opinion on the merits and demerits of this case, the petitions filed by the petitioners are disposed of, reserving liberty to the petitioners to submit their detailed representation to the Commissioner for Survey, Settlement and Land Records, within a period of 15 days from the date of receipt of a copy of this order.
If such a representation is given by the petitioners to the Commissioner for Survey, Settlement and Land Records, within 15 days as stipulated, he shall examine it and submit his report to the Government 61 within two months and the Government shall take a decision thereon as far as possible, within six months from the date such report is submitted by the Commissioner for Survey, Settlement and Land Records.
In view of the disposal of the writ petitions, the relief sought in I.A.No.I/2012 does not survive for consideration. Hence, it is disposed of as having become infructuous. Ordered accordingly.
