The present bail application has been filed on behalf of applicant Hari Singh under Section 439 of the Code of Criminal Procedure, with a prayer to enlarge him on bail in Case Crime No. 672 of 2018 for offence punishable under Sections 419, 420, 406, 409 & 120-B of the Indian Penal Code, registered at Police Station- Cantt., District- Gorakhpur during pendency of the trial, after rejecting the bail application of the applicant by Additional Sessions Judge, Court No. 1, Gorakhpur vide order dated 25.08.2023 Learned counsel for the applicant submits that the applicant is innocent and he has been falsely implicated in the present case due to ulterior motive. It is further submitted that the first information report dated 04.08.2018 was lodged under Section 419, 420, 406, 120-B IPC against the applicant and five other named persons alleging that the applicant and other accused persons, who were Directors and other office bearer of the companies misappropriated the money of investors. It is further submitted that as per allegation of the FIR, the applicant is Director of the Greenage Food Product Limited and Begal Pincon Housing Infra Structure Limited.
