6. Having considered the facts as well as the submissions made by the respective parties, the issue arise as to whether the order of detention passed by the Detaining Authority in exercise of his powers under the provisions of the Act of 1985 is sustainable in law?
7. The order impugned was executed upon the petitioner and presently he is in Jail. In the grounds of detention, a reference of four criminal cases i.e. (i) for the offence under Sections 65AE, 81 & 83 with Himmatnagar "A" Division Police Station dated 11.08.2023, (ii) for the offence under Sections 65AE, 116B, 98(2), 81, 83 with Himmatnagar "A" Division NEUTRAL CITATION C/SCA/3915/2024 JUDGMENT DATED: 20/06/2024 undefined Police Station dated 26.03.2023, (iii) for the offence under Sections 65AE with Gambhoi Police Station dated 11.03.2023, (iv) for the offence under Sections 279 of IPC, sections 177, 184 of M.V. Act and Section 65 of Prohibition Act with Bhiloda Police Station dated 13.02.2023, registered against the petitioner under the Prohibition Law was made and further it is alleged that, the activities of the detenue as a "bootlegger" affects adversely or are likely to affect adversely the maintenance of public order as explained under Section 3 of the Act of 1985. Admittedly, in said offences, the petitioner was granted bail.
