9. The Indian Council of Forestry Research & Education, Dehradun, ('ICFRE' for short), was directed to conduct a study in terms of the directions given by the Tribunal in its order dated 19.04.2018.

Accordingly, the ICFRE had submitted its report on 29.01.2019 and the Tribunal in its order of 01.07.2020 observed that the said report pertains only to the Districts of Dumka and Pakur in the State of Jharkhand. The State of Jharkhand was, therefore, directed to ensure recovery of Environmental Compensation from the erring stone mine and stone crusher units following the 'Polluter Pays' Principle expeditiously, as far as it may be practicable, within three months from hence and submit a report.
14. So far as the Birbhum District of State of West Bengal is concerned, it was pointed out by the learned Counsel that the ICFRE had sought certain information from the State Pollution Control Board which had been furnished and it was being examined by the ICFRE.
15. Thereafter, the Tribunal by its order dated 04.01.2021, directed that the State of Jharkhand shall complete the process of recovery of Environmental Compensation and restitution of Environment by the next date.
16. We also find that in some of the connected cases, the ICFRE report has also been challenged and, therefore, direction was issued to implead the ICFRE in the array of Respondents.
17. In the present Original Application several I.As. have been filed which will be addressed hereinafter:-
I.A. No. 12/2021/EZ:-
1. This I.A. has been filed by the Applicant, M/s Madhucon Projecs Limited, for impleadment in the Orignal Application.
2. We find that the Tribunal vide its order dated 22.06.2021 had allowed the said prayer in the I.A. and the Applicant was impleaded as Respondent No.420 in the array of Respondents.
3. The Applicant in the I.A. is further challenging the report of the ICFRE, Dehradun, dated 29.01.2019, and for setting aside/quashing of the impugned Penalty Notice No. 2177/M dated 01.12.2020, issued by the District Mining Officer, Pakur, Jharkhand, in pursuance of the ICFRE, Dehradun, report
4. The Penalty Notice directed the Applicant to deposit a total amount of Rs. 117.97 lakhs out of which Rs. 110.00 lakhs is stated to be the cost of mined material, both legally and illegally mined.
