2. In response to the notice issued, accused had filed compliance affidavit on 03.01.2023 and being not satisfied with the compliance affidavit, this Court by its order dated 03.01.2023, directed the learned counsel for the accused to file the better affidavit of compliance. Accordingly, Sri. Chandranath Ariga, learned counsel for accused Nos.1 and 2 filed the compliance affidavit of Sri. Prakash .K, Panchayath Development Officer, Varanga Grama Panchayath, Hebri Taluk, Udupi District along with copy of Licence and Sanctioned Plan and specifically stated at paragraph Nos.4 and 5 as under:
5. I submit that upon verification, it is found that the license to construct is over Sy.No.12/51 of Varanga Village and the construction is on the said land."
3. Further learned counsel for the accused also filed additional memo dated 10.01.2023 producing the conversion order passed by the Deputy Commissioner, Udupi District in respect of land bearing Sy. No.12/51. Thereby, the order passed by the learned Single Judge has been complied.
