He would further submit that as regards the contention that some of the properties have been independently dealt with is not a conclusive indicator of the earlier partition of the joint family properties and it only shows that other sharers have acquiesced in the transactions made by the Plaintiffs and the properties which have been individually sold can be put to his share in order to make partition equitable.
