1. Heard Mr. Yogen Pandya, learned advocate for the petitioner and Ms. Parul Vasavada, learned advocate for the respondent No.1.
2. One of the contentions of the petitioner before the Labour Court was to the effect that during the period of his suspension, no subsistence allowance was paid to him, which resulted into denial of reasonable opportunity to defend him in the inquiry. Ultimately, the punishment of dismissal was imposed which was the subject matter of the Reference before the Labour Court, which is rejected. The matter requires consideration. Rule. Ms. Parul Vasavada, learned advocate waives service of rule on behalf of respondent No.1.
