5. Per contra, learned APP has vehemently opposed the present application for grant of regular bail contending that the applicant has played an active role in commission of the offence in question. The present applicant was present in the Creta car which had followed the bus, wherein the employee of the Angadia pedhi was travelling and the said Creta car had intercepted the bus, from where the victim was taken out and looted by the other co-accused. The gold which had been looted from the employee of the Angadia pedhi has also been recovered. He therefore submitted that looking to the nature and gravity of offence, this Court may not exercise the discretion in favour of the applicants and the application may be dismissed.

6. Heard learned advocates for the respective parties and perused the record. From the record it appears that the investigation is over and charge- sheet has been filed. The role attributed to the present applicant in commission of the offence is to the effect that the applicant was present in the Creta car which had followed the bus, wherein the employee of the Angadia pedhi was travelling. Except this, no other overt act had been attributed to the present applicant for commission of offence in question, nor any recovery of any muddamal article has been effected from the present applicant. Considering the same, the application deserves consideration.
