However, now it is stated that only Respondents No.2 & 3 have filed dispute u/s 91 of the Maharashtra Co-operative Societies Act (for short MCS Act) against Respondent No.1 and the same is pending. The facet of majority decision by any society as contemplated and available under section 77 of the MCS Act and Rules just cannot be overlooked while considering the grant of reliefs as prayed. Admittedly, Respondents No.2 & 3 have full knowledge about this development, in fact participated also though objected as stated above. Therefore, the submissions as they are not agreeing to this resolution and, therefore, they are not bound by the Agreement between the Petitioner and Respondent No.1 is unacceptable.
