JUDGMENT
Sri. Shankar, learned counsel for the appellant - assessee submits that in view of the fact that the questions which the assessee seeks to raise in this appeal but arising out of the order passed by the Tribunal on an application under section 254[2] of the Income Tax Act, 1961, but rejecting the same, has already been made subject matter of appeal against the original order of the Tribunal and that appeal is pending, the present appeal is not pressed for examination and the appeal may be permitted to be withdrawn.
