Therefore on and after 3.5.1994, the report/certificate of the MCD about the structural features of the building and whether the Rules in that behalf had been duly complied with, was a condition precedent for renewing the annual license or even granting a temporary lease by the licensing authority. This showed that as far as the structural features and deviations and defects, the Licensing Authority relied upon the MCD, for expert opinion after 3.5.1994.
The question is whether MCD can be made liable to compensate the victims of the fire tragedy, on the ground that it was required to give an inspection report or on the ground that it gave a no objection certificate on 25.9.1996 for renewal of licence for 1996-97.
