Ms. Anjali Noliyal, Advocate for the petitioner.
Mr. S.K. Mishra, Standing Counsel for the State / respondent no. 29.
By means of present writ petition, the petitioner seeks to issue a writ, order or direction quashing / setting aside the impugned order dated 21.08.2017, passed by Addl. Commissioner, Garhwal Mandal, Camp Dehradun, in revision no. 52/2016-17, u/s 333 U.P.Z.A. & L.R. Act, Mahboob Ali vs Gul Hasan and others.
Plaintiff/petitioner filed a revenue suit against respondent no. 2 and others in the court of Asstt. Collector, I Class, Vikasnagar, Dehradun under Section 229B of U.P.Z.A. & L.R. Act. Asstt. Collector passed an order directing the parties to maintain status quo over the land in question. Respondent no. 1 and others filed revenue revision before Addl. Commissioner, Garhwal Mandal, Camp Dehradun. Addl. Commissioner allowed the revision and set aside the order dated 21.03.2017, passed by learned Asstt. Collector, I Class. A direction was given to the Assistant Collector, I Class to decide the pending application under Section 229D of U.P.Z.A. & L.R. Act. Aggrieved against the same, present writ petition has been filed by the plaintiff- petitioner.
After arguing the writ petition at some length, learned counsel for the petitioner confined her prayer only to the extent that the Asstt. Collector may kindly be directed to decide the pending application under Section 229D of U.P.Z.A. & L.R. Act, at an earliest possible, as per law.
Mr. S.K. Mishra, learned Standing Counsel for the State, representing respondent no. 29, has no objection to such innocuous prayer of learned counsel for the petitioner.
