Heard learned counsel for the petitioner and learned Assistant Government Pleader for Social Welfare appearing for the respondents. With their consent, the writ petition is being disposed of at the admission stage.
The case of the petitioner is that he intended to admit his younger daughter in Government Degree College and applied to the 3rd respondent for issuance of caste certificate recognizing the caste as 'Perika Balija'. The 3rd respondent vide endorsement in Rc.B.17/2021 dated 11.05.2021, refused to issue caste certificate inter alia stating that as per the enquiries caused by him through his subordinates, they came to know that there are no persons belonging to 'Perika Balija' community in the area and that the petitioner belong to 'Balija' community. Aggrieved by the endorsement given by the 3 rd respondent, petitioner preferred appeal before the 2 nd respondent on 04.06.2021, and the same was acknowledged. The petitioner came to know that thereafter the 2nd respondent called for required information from the Revenue Divisional Officer, Kurnool, and the 3rd respondent has also sent the required information. However, the 2nd respondent is not passing orders on the appeal. Aggrieved by the inaction of the 2nd respondent in disposing the appeal, the present writ petition is filed.
