The petitioner challenges the order dated 22.08.2013 in O.A.No.620 of 2012, rejecting his request to enhance the Time Related Continuity Allowance (hereinafter referred to as TRCA).

The petitioner joined the Postal service as Extra Department Delivery Agent. The post is now re-designated as Grama Dak Sevak.

The Postal Department constituted a Committee under the Chairmanship of Justice Talwar for revision of pay and allowance. The Committee made a recommendation to fix TRCA to Grama Dak Sevaks, depending upon their workload. TRCA of the petitioner was fixed at Rs.1,375-25-2125. The petitioner appears to have made a representation in 1999 to revise his TRCA. However, the issue was not considered. Thereafter, another Committee was constituted for further revision. The petitioner once again submitted a representation on 07.04.2012 to revise his TRCA at Rs.4220-75-6470. The said representation was rejected by order dated 24.04.2012. The said order was challenged by the petitioner before the Madras Bench of the Central Administrative Tribunal (hereinafter referred to as the Tribunal) in O.A. No.620 of 2012.

Before the Tribunal, the petitioner contended that the information furnished by the Postal Department dated 25.03.2010 clearly proved that the Grama Dak Sevak employees should work for a minimum of 4 hours. In view of the same, TRCA has to be enhanced.

The Original Application was opposed by the respondents. The respondents have taken up a contention that the workload is periodically assessed based on the statistics collected. The respondents have further contended that TRCA used to be revised, taking into account, the statistics of working hours.

The Tribunal accepted the explanation submitted by the respondents and dismissed the Original Application. The said order is under challenge in this writ petition.

We have heard the learned counsel for the petitioner. We have also heard the learned Standing Counsel for respondents 1 to 3.

The factual matrix clearly shows that the workload of the post of Grama Dak Sevaks was fixed as 4 hours and 51 minutes. The review for fixing the workload was held in July 2011. The Postal Department fixed the TRCA at Rs.4220-75-6470 based on the recommendation of K.S. Nataraja Murti Committee. The workload of the petitioner was arrived at 4 hours and 51 minutes. It was only on the said basis, TRCA of the petitioner was fixed.

The respondents have given detailed statistics which made them to fix the TRCA. This aspect was considered by the Tribunal once again. The Tribunal has arrived at a factual finding that the TRCA was rightly fixed, taking into account, the workload. Therefore, we do not find any reason to take a different view in the matter.

In the result, the writ petition is dismissed. No costs. Connected Miscellaneous Petition is closed.
