ORAL ORDER
2 29-03-2018Heard learned counsel for the petitioner and learned counsel for the State.
The present application has been filed for modification of the order dated 19.02.2018 passed in Cr. Misc. No. 9534 of 2018 by which the petitioner was granted bail in connection with Madhubani Mahila P.S. Case No. 31 of 2017, pending in the Court of learned S.D.J.M., Madhubani under Sections 341, 323, 498A, 379 of the Indian Penal Code and ¾ of the Dowry Prohibition Act and the petitioner was directed to surrender in the Court below within a period of six weeks and furnish bail bonds.
Counsel for the petitioner submits that inadvertently in the Patna High Court Cr.Misc. No.17070 of 2018(2) dt.29-03-2018 2/2 petition of Cr. Misc. 9534 of 2018, the father's name of petitioner was written as Sameerchandra Paswan, R/o- Sanda while correct name of the petitioner's father is Aammerchandra Paswan and he is resident of Samda.
Considering the submissions made on behalf of the learned counsel for the petitioner and the facts stated in paragraph 3 of the modification application, the order dated 19.02.2018 passed in Cr. Misc. No. 9534 of 2018 is modified to the extent that in the cause title "Sameerchandra Paswan, R/o- Sanda" be read as "Aammerchandra Paswan, R/o- Samda". The period of surrender of the petitioner in the Court below is extended for a further period of six weeks from the date of receipt/production of a copy of this order. The rest of the conditions stipulated in the order will be same.
The order dated 19.02.2018 passed in Cr. Misc. No. 9534 of 2018 is modified to the extent as indicated above.
The modification application is, accordingly, allowed.
