Investigation further revealed that accused Naresh Kochar presented cheque of his uncle Sh. Raj Kumar Kochar bearing no. 056091 dated 20.01.1995 of the firm M/s N.B. Pharma for Rs.2,45,000/ to discount and credit the same in account no. 1042 of M/s Narain Das Agencies. This cheque was CBI vs Jasbir Singh Chawla & Ors. 5/173 presented to accused Jasbir Singh Chawla and he purchased the same inspite of the fact that the earlier five cheques had already been dishonoured. The said cheques were issued by Sh. Raj Kumar Kochar for M/s N.B. Pharma in which he (Raj Kumar Kochar) is a partner. The account of M/s N.B. Pharma bearing no. 1015 is maintained with PNB, Sonepat. Accused Devinder Singh Bhatia credited the same in account no. 1042 vide OBP No. 6755 dated 25.01.1995 and sent for collection from PNB, Sonepat, Haryana through Punjab & Sind Bank, Sonepat. The cheque was dishonoured due to insufficient amount. Inspite of receiving the said dishonoured cheque accused Jasbir Singh Chawla did not reverse the entry in OBP register and it is not debited in the party account and shown outstanding to show the favour of the party. Accused Devinder Singh Bhatia also shown false entry in the OBP Register and had sent many reminders to Punjab & Sind Bank, Sonepat though accused Jasbir Singh Chawla kept the said cheque with himself illegally for favouring the party.
It has been further revealed during investigation that inspite of all the above dishonoured cheques, cheque no. 056092 dated 13.02.1995 for Rs.2,88,000/ of M/s N.B. Pharma signed by accused Raj Kumar Kochar also purchased and discounted in the account of M/s Narain Das Agencies, accused Jasbir Singh Chawla ordered to Sh. M.S. Kapoor to purchase the said cheque. As per the charge sheet, the payinslip was not traceable in this case. The said cheque returned due to insufficient amount in the account from PNB, Sonepat but the entries to this effect was not made in the OBP register. Similarly, cheque no. 056094 dated 04.05.1995 for Rs. 3 lacs from account no. 1015/3345 of M/s N.B. Pharma was presented by M/s Narain Das Agencies on 09.05.1995 for discount. The said cheque was purchased by accused Jasbir Singh Chawla himself and Sh. M.S. Kapoor credited the same in the account. The said cheque was sent for collection to Punjab & Sind Bank, Sonepat through Sh. Prem Singh Wadhwa and on being dishonoured, the cheque was returned to accused Jasbir Singh Chawla through Sh. Prem Singh CBI vs Jasbir Singh Chawla & Ors. 7/173 Wadhwa on 10.05.1995. Sh. Jasbir Singh Chawla did not make entries in the concerned register and also did not make any entries in the account of the firm.
The PW7 Ved Prakash was Branch Manager in Punjab & Sind Bank and proved Productioncumseizure memo ExPW7/A(D
65). He deposed that a cheque bearing no. 056091 for Rs. 2,45,000/ ExPW3/13 was sent from their branch of Sonepat for clearing, but the same was returned back unpaid as mentioned at point B on Mark ExPW7/PX1. He has further deposed that a cheque bearing no. 056092 for Rs. 2,88,000/ ExPW3/15 was sent from their branch of Sonepat for clearing, but the same was returned back unpaid as mentioned at point B on Mark Ex PW7/PX2. It is further submitted by PW7 that a cheque bearing no. 056094 for Rs. 3,00,000/ ExPW3/17 was sent from their branch of Sonepat for clearing, but the same was returned back unpaid as mentioned at point B on Mark ExPW7/PX3; Cheque no.56092 was returned by their branch vide letter dated 16.03.95 Mark PW7/PX6 and return memo Mark PW7/PX7 and Cheque no.56094 was returned by their branch vide letter dated 10.05.95 Mark PW7/PX8 and return memo Mark PW7/PX9.
The PW8 Om Prakash was posted as Peon cum driver in Punjab National Bank, Main branch Sonepat, Haryana in year 1998 and proved productioncumseizure memo dated 03.06.98 Ex PW8/A(D63) and memo dated 24.04.98 as Ex.PW8/B. He deposed CBI vs Jasbir Singh Chawla & Ors. 27/173 that the specimen signature of accused Naresh Kumar Kocchar were obtained in his presence on 16 sheets marked as S1 to S5 and S18 to S27(D68).
