Heard both sides.

Petitioner apprehends her arrest in Bahadurpur P.S. Case No.161 of 2016 registered under Sections 341, 323, 373, 406, 428 and 504/34 of the Indian Penal Code.

The informant alleged that he had talked with the petitioner for purchasing a piece of land on payment of consideration of Rs.90,00,000/-. The deed of agreement to sell was also executed and informant advanced money but later on the petitioner, her husband and other family members refused to execute the sale deed.

Learned counsel for the petitioner submits that the husband of the petitioner earlier filed Cr. Misc. No.40650 of 2017 for grant of anticipatory bail and the case was Patna High Court Cr.Misc. No.80154 of 2018(2) dt.16-01-2019 2/2 compromised. On the basis of such compromise, the husband of the petitioner was granted anticipatory bail vide order dated 12.01.2018 on the condition that the entire amount shall be paid to the informant by the end of December, 2019. It is further submitted that the petitioner is also bound to terms and conditions of the agreement.

Considering the facts aforesaid, let petitioner, above named, in the event of her arrest or surrender before the court below within a period of four weeks from the date of receipt of this order be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM, Patna City in connection with Bahadurpur P.S. Case No.161 of 2016, subject to the conditions laid down under Section 438(2) Cr.P.C.
