(2) The writ petition was not maintainable against the Delhi Stock Exchange even if it is a State within the meaning of Article 12 of the Constitution of India, as it does not perform any public duty as in the writ petition, the respondent intended to enforce a contract of service. It is also contended that a writ will lie only when the authority exercises functions of public law character and not otherwise. A writ may lie against a public functionary in relation to a discharge of public of public function but not when the relief sought for in the writ petition arises out of a contract.
