In the context of this case, admittedly, the Petitioner is a Body Corporate, constituted under the provisions of the Major Port Trusts Act, 1963, as amended by the Major Port Trusts (Amendment) Act, WP-5678-15.doc 18 Of 29 1974. Petitioner is a successor-in-title of the Board of Trustees of Port of Bombay, a Body Corporate, constituted under the provisions of the Bombay Port Trusts Act, 1879. In short, the premises in question, therefore, belong to the Board of Trustee of Port of Bombay. The question for consideration is, 'as to whether the Bombay Rent Act was applicable to the premises owned by the Port Trust?'' In this respect, Section 4(i) of the Bombay Rent Control Act is relevant. It provides as follows :-
