                  PRAYER: Second Appeal is filed under Section 100 of the Civil Procedure
                  Code, to set aside the Decree and Judgment dated 25.07.2011 rendered in
                  A.S.No.1 of 2011 on the file of the Subordinate Court, Sivakasi, confirming
                  the Decree and Judgment, dated 07.10.2010 rendered in O.S.No.491 of 2004
                  on the file of the District Munsif Court, Sivakasi, by allowing this Second
                  Appeal and to grant such other reliefs.

                                                     JUDGMENT

The Learned Counsel appearing for the sole Appellant submitted that the sole appellant died. Hence, this Court directed the Learned Counsel https://www.mhc.tn.gov.in/judis 2 to take effective steps and granted sufficient time more than 4 weeks.

Eventhough sufficient time was granted no steps was taken.

2. Therefore, this Second Appeal is dismissed as abated.

However, liberty is granted to the Legal heirs of the sole appellant to restore and adjudicate this matter, if so advised. No Costs. Consequently, connected miscellaneous petitions are closed.
