Thereafter, Sucha Singh-petitioner filed ejectment application under Section 14-A(i) of the Act before the Assistant Collector, Ist Grade, Batala, who accepted the same on 5.1.1996. The appeal was dismissed by the Collector. In the execution of the ejectment order dated 5.1.1996, petitioner- Sucha Singh was handed over the possession, vide Rapat No.345 dated 7.5.1999. Thus, petitioner Sucha Singh became owner in possession of Khasra no.2-R/24/1 measuring 4 kanals 1 marla.
This land was sold by Sucha Singh-petitioner to one Sohan Singh and possession was also delivered. Consequently, mutation no.2673 was sanctioned in the name of Sohan Singh, which came to be recorded as such in the jamabandi for the years 1993-94 and 1998-99. Khasra Girdawari of this land was also corrected in the name of Sohan Singh on 31.1.2001 by the Assistant Collector, 2nd Grade, Batala.
