(29) Before coming to the merits of the grounds raised before me, it is necessary to briefly deal with the existing legal position relating to the Rights of the parties before this Court and actionable wrong if any. (30) Coming first to the arguments of the Ld. Counsel plaintiff that by telecast of the docudrama, the reputation of the plaintiff which is an inseparable facet of life has been violated, the act of the defendants thereby infringing upon the Fundamental Right of the plaintiff. The first question which now arises for determination is whether Right to Reputation is a Fundamental Right under the Constitution of India or not? In this regard, I may observe that the International Covenant on Civil and Political Rights, 1966 recognized the right to have opinions and the right to freedom of expression under Article 19 has been recognized to be the subject to the right of reputation of others.
