Mr. Subir Sanyal, learned senior advocate appearing for the respondent Board referring to Rule 4(b) of the Rules of 2002 submits that on an application from a teacher a mutual or single transfer is effected. Thus, the rules specifies of a single application and not three applications at time. Moreover, for the administrative convenience, mutual transfer of three persons at a time is uncalled for. The orders passed by the Council are dehors existing rules. He also indicates that for mutual transfer one has to apply through on-line portal "Utsashree" which is effective from 2024. The application by the petitioners for mutual transfer, if filed through on-line, can be considered and processed. There is no such option in the on-line portal to have transfer of three persons mutually at a time. In light of the aforesaid submission he seeks for dismissal of the writ petition. However, he informs the Court that if the petitioners file separate application for mutual transfer through "Utsashree" portal then Board will consider the same in accordance with law.

9. Rule 4(b) clearly envisages that an application is to be made by a teacher seeking for mutual transfer or single transfer. The portal of the Board, namely "Utsashree" has been designed for processing the transfers of teachers, single or mutual, as the case may be. It is found that the petitioners have not applied through "Utsashree" portal. Such portal is in existence for effecting transfers. It will be appropriate for the petitioners to avail such online portal seeking their transfer.

10. In the circumstances of the present case, the petitioner cannot claim parity with the order passed by the Chairman of District Primary School Councils annexed to the supplementary affidavit.

11. In light of the aforesaid discussions, liberty is granted to the petitioners to apply online separately through "Utsashree" portal within a period of four weeks from date. Upon such application been made, the Board shall consider the same in accordance with law.
