3. Appellant's first bail application in the form of criminal appeal under Section 14-A of SC/ST act was disposed of as withdrawn and not pressed with liberty to revive the prayer for bail after evidence of prosecutrix before the trial Court or receipt of DNA report, whichever is earlier, vide order dated 01.05.2023 passed in CRA No.3747 of 2023.

4. As per the prosecution story, on 20.11.2022, 32 years old prosecutrix lodged an F.I.R. alleging that she belongs to Scheduled Caste and used to perform dance program in orchestra. On 19.11.2022 at about 10:00 am in the morning, applicant Ramjee Yadav made a call and hired her for a program for Rs.3,000/-. At around 07:30 pm at Nawgaon Bus Stand, Ramjee Yadav met her on a motor-cylce and took her towards Garroli and thereafter, committed rape upon her in the forest. When she tried to run away then again committed the same act with her. After investigation charge-sheet has been filed.
