1. This hearing has been done through hybrid mode.
2. The Petitioner in W.P.(C) 5701/2022 is permitted to file the additional affidavit within 6 weeks with advance copy to the ld. Counsels in all the matters, who shall respond within 6 weeks thereafter. CM APPL.3760/2022, CM APPL.34311/2022 & W.P.(C) 7161/2022
3. Insofar as CM APPL.34311/2022 for preponement of present writ petition is concerned, the same is disposed of.
4. Application being CM APPL. 3760/2022 has been filed seeking permission to travel abroad to Qatar and UAE from 10th February 2023 to Signature Not Verified Digitally Signed By:DEVANSHU JOSHI Signing Date:30.01.2023 12:56:19 18th February, 2023.
5. It is stated that the Petitioner - Aman Sethi wishes to travel to Qatar and UAE to attend marriages and related ceremonies of his close family friend's children.
6. Ld. Counsel for the Petitioner submits that the Petitioner has been previously permitted to travel abroad vide orders dated 9th May, 2022, 28th June, 2022, 14th November, 2022 and 14th December, 2022 passed by this Court.
7. Considering that the Petitioner has returned to India on all previous occasions and has also complied with the conditions imposed by this Court, the Court is inclined to give permission to the Petitioner to travel to Qatar and UAE from 10th February 2023 to 18th February, 2023, subject to the following conditions:
a) That the sale deed, which was deposited as security in terms of order dated 9th May, 2022, shall continue to remain deposited with this Court.
b) That the undertaking given to the worthy Registrar General not to create any third party interest in the property, would continue. Fresh undertakings given by the Petitioner along with this application are taken on record.
c) That the immovable property, which the bank has already taken possession of, shall not be disposed of. An undertaking to this effect, which is stated to have been filed, shall be examined and accepted by the worthy Registrar General.
d) That the undertaking that the Petitioner will return to India not later than 18th February, 2023, has also been filed with the Signature Not Verified Digitally Signed By:DEVANSHU JOSHI Signing Date:30.01.2023 12:56:19 present application, along with the itinerary. The same shall be examined and accepted by the worthy Registrar General.
e) That the Petitioner has also stated in the affidavit that his number +91 9818099999 shall remain active during the period he stays abroad,. The Petitioner shall ensure that the said number will be kept operational at all times, subject to all exceptions, including the period he is on board the aircraft.
f) That he shall intimate the Court/Bank before leaving and within 72 hours of his return from abroad.
g) That the permission to travel abroad given in this order shall be subject to other applicable conditions and will not be deemed as a direction to any other authority.
h) That in case any of the above conditions are violated, the security will be forfeited to the State.
8. With these observations and conditions, the application is disposed of.
9. List W.P.(C) 7161/2022 before the Registrar on 2nd February, 2023.
10. List all these petitions before the Court for hearing on 15th May, 2023.
