The applicant, after obtaining the degrees in B.Tech., M.Tech. and Ph.D. in Electronics Engineering, initially joined as a Reader [pay scale of Rs.12000-18300/- (pre-revised)] in the Department of Electronics & Communication Engineering, Institute of Engineering & Technology, MJP Rohitkhand University, Bareilly, on 26.2.2005. On being recommended by the Union Public Service Commission, he was appointed by the respondent-Department as an Assistant Professor in Electronics Engineering in Ambedkar Institute of Advanced Communication Technologies & Research, Delhi, and accordingly, he joined on 31.1.2008. The pre-revised pay scale of the said post of Assistant Professor was Rs.12000-18300/-. The All India Council for Technical Education(AICTE), vide notification dated 5.3.2010 (Annexure A/4), recommended pay scales and other service conditions of the teachers and staff of Degree Level Technical Institution and Delhi Technological University. The said recommendations of the AICTE were accepted in totality by the respondent-GNCTD, vide Cabinets decision dated 12.7.2010. Accordingly, office order dated 29.7.2010(Annexure A/5) was issued by the Department of Training & Technical Education, GNCTD. As per office order dated 29.7.2010 ibid, incumbent Assistant Professors and Lecturers (Selection Grade), who have completed 3 years service in the pre-revised pay scale of Rs.12000-18300/- on 1.1.2006 shall be placed in the Pay Band of Rs.37400-67000 with AGP of Rs.9000/- and designated as Associate Professor. Accordingly, by office order dated 28.12.2010 (Annexure 6), the applicants pay was fixed in the Pay Band of Rs.37000-67000/- with AGP of Rs.9000/- and the applicant was designated as Associate Professor with effect from 26.2.2008. Clause 12.1(xiii) of the office order dated 29.7.2010 ibid stipulates that Associate Professor completing 3 years of service in the AGP of Rs.9000/- and possessing Ph.D.Degree in the relevant discipline shall be eligible to be appointed and designated as Professor in the Pay Band of Rs.37400-67000/- with AGP of Rs.10,000/- subject to other conditions of academic performance [i.e., Performance Based Appraisal System (PBAS) and Academic Performance Indicator (API)] as laid down by the AICTE. The duly constituted Selection Committee, which met on 30.9.2011, conducted the interview and recommended the applicant for promotion under the Career Advance Scheme (CAS) to the post of Professor with effect from 26.2.2011, vide minutes of the Selection Committee dated 30.9.2011 (Annexure 8). As the applicant did not get any order promoting him to the post of Professor with effect from 26.2.2011 on the basis of the recommendation of the Selection Committee, he made representations to the respondents on 21.8.2012, 7.11.2012, 21.11.2012 and 12.12.2012. There being no response, the applicant filed the present Original Application on 15.4.2014 praying for a direction to the respondents to place the minutes of the Selection Committee, dated 30.9.2011, qua the applicant, before the Lt.Governor of Delhi (respondent no.4) for approval and accordingly, promote the applicant to the post of Professor under the CAS with effect from 26.2.2011 with all consequential benefits, viz., seniority, and arrears of salary with interest @ 18% per annum.
