ORAL ORDER
3 07-05-2015It has been submitted on behalf of the learned counsel for the petitioners that petitioner no. 1 has already been arrested by the police. Hence, the application of petitioner no. 1 has become infructuous. Hence, he does not want to press the application in respect of petitioner no. 1.
The petitioner nos. 2 and 3 are apprehending their arrest in connection with Sakra P.S. Case no. 525 of 2014 for the offence under Sections 363, 366A of the Indian Penal Code and 12,17, 18 of the Prevention of Children From The Sexual Offences Act.
Heard learned counsel for the petitioner and the State.
The prosecution story, in brief, is that the informant's sister-in-law namely Puja Kumari was traceless since 03.11.2014. On search it came to know that the Patna High Court Cr.Misc. No.50760 of 2014 (3) dt.07-05-2015 2 petitioners have enticed the victim girl and have kept her captive in the house of one Sri Ram Rai. Later with the help of administration, victim girl was recovered.
It is submitted on behalf of the petitioners that the petitioner nos. 2 and 3 are the ladies. There is no direct allegation made against the petitioner nos. 2 and 3. Moreover, the allegation is against Sri Ram Rai, from whose house the victim girl was recovered. Further it is been submitted that the petitioner no. 2 is an old lady and petitioner no.3 is the daughter-in-law of the petitioner no. 1.
On behalf of the State, it has been submitted that the petitioner nos. 2 and 3 are named in the F.I.R.
Considering the aforesaid facts, let the above named petitioner nos. 2 and 3, in the event of their arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge, P.O.C.S.O. Act, Muzaffarpur in connection with Sakra P.S. Case No. 525 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
