02] The facts relevant for the decision of present petition may be stated in brief as under :

i. Respondent was appointed as helper in Rest House, Mozari since 19/05/1985. His services came to be terminated on 30/04/1987. He raised the dispute.

Additional Commissioner referred the dispute for adjudication to Labour Court, Amravati. In the statement filed before Labour Court, claim of respondent was that he had continuously worked for more than 240 days preceding the date of termination on 30/04/1987 and without complying with the mandatory provisions of Section 25F and 25G of the Act read with Rule 81 of the Industrial Disputes (Bombay) Rules, 1957 (hereinafter referred to as 'the Rules' for short), his services were terminated.
