4. CAN 1 of 2024 is now taken up for hearing. In view of the Second Appeal being admitted previously, we are of the opinion that a strong prima facie case for hearing the appeal on merits has been made out. Accordingly, there shall be a stay of all further proceedings in Ejectment Execution Case No. 593 of 2023 pending before the Third Bench, Presidency Small Causes Court, Calcutta till disposal of the application. The appellant/petitioner shall serve copies of the application on the plaintiff/respondent indicating that the application shall be listed for hearing on January 7, 2025 before the learned Single Judge having determination, subject, of course, to the convenience of the said Bench, when the appellant/petitioner shall file an affidavit of service to that effect.
