DMI FINANCE PRIVATE LIMITED ..... Petitioner
Through: Mr.Kinshuk Chatterjee, Adv.
versus
ABLOOM INFOTECH PRIVATE LIMITED & ANR.
..... Respondents
Through: None.
CORAM:
HON'BLE MS. JUSTICE REKHA PALLI
ORDER
% 19.10.2020
1. This is a petition under Section 9 of the Arbitration and Conciliation Act, 1996 seeking the following reliefs:-
"a) Pass an order restraining the Respondents from transferring, alienating, disposing or in any manner creating any third-party interest, encumbrance, charge, the lien on any of assets of Abloom Infotech Private Limited; and
b) Pass such other further Orders as this Hon'ble Court may deem fit and proper in the facts and circumstances of the present case."
2. After some arguments, learned counsel for the petitioner submits that since a number of inadvertent typographical errors have crept up in the present petition, it would be more appropriate for the petitioner to file a fresh petition instead of amending the present petition. He, therefore, seeks leave to withdraw the petition with liberty to file a fresh petition on the same cause of action.
3. The petition is accordingly dismissed as withdrawn along with the pending application with liberty as prayed for.
