According to the petitioner, the prayer sought for in the OA is contrary to the conditions stipulated in the EC/Amendment/Extension already granted by the second respondent, who is the expert body, wherein the petitioner is permitted to use 4 nos. of Poclains in the subject quarry and the prayer in the OA is nothing but challenging the conditions in the EC, which can be challenged before the National Green Tribunal, under Section 16(h) of the NGT Act, 2010 within 30 days from the date of EC.
