Heard learned counsel for the parties.

2. Petitioner is aggrieved by the order dated 5.8.2011, Annexure-1 passed by the House Controller, Jehanabad in BBC Case No. 1258/11 which order is appealable under Section 24 of the BBC Act. In such circumstances, I am not inclined to interfere with the matter.

The writ petition is, accordingly, dismissed.

3. In case, the appeal is filed within 15 days from today, the Appellate Authority may consider the request of the petitioner for condonation of delay in filing the appeal in view of his subsequent conduct that he chose to seek review of the order dated 5.8.2011, Annexure-1 by filing petition dated 25.10.2011 i.e. after expiry of the period for filing the appeal.
