The grievance of the petitioners is that the interim order of stay that was granted by respondent No.2-Deputy Director of Land Records (DDLR) has been vacated immediately after objections are filed at the hands of respondent No.5 on the NC: 2025:KHC:35733 HC-KAR date of appearance i.e., on 03.09.2025. Learned counsel points out to the impugned order dated 03.09.2025, which shows that respondent No.5 appeared before the DDLR on 03.09.2025 and filed objections and documents. The DDLR therefore vacates the interim order of stay without assigning any further reason.

2. Learned counsel for respondent No.5 fairly submits that the impugned order may be set aside by directing the DDLR to consider the contentions of both sides and pass order on the interim prayer made by the petitioners herein, within a fixed time.

3. Accordingly, the writ petition is allowed by setting aside the impugned order dated 03.09.2025 passed by respondent No.2-DDLR in case bearing No.Buthasum.Appeal/323/2025-26 at Annexure-A. The DDLR is directed to hear both the sides before considering the interim prayer made by the petitioners herein for stay of the orders passed by the DDLR. The DDLR shall pass necessary orders on the interim prayer and the objections filed by respondent No.5 herein as expeditiously as possible and at any rate, within a period of two weeks from 15.09.2025.

4. The parties are directed to appear before the DDLR on 15.09.2025 and DDLR shall hear the learned counsels on both sides and pass necessary orders.
