It was 4 WA.883.2018 urged that there cannot be any disqualification based upon the fact that the candidate has passed the examination in two attempts. It was urged that the rejection was contrary to the advertisement and the recruitment rules.

(4) Learned Single Judge non-suited the petitioner on the findings that as per advertisement the selection to Group 4 posts, which comprised of Assistant Grade III/ Stenographer/ Steno-typist/ Data Entry Operator/ IT Operator, was to be in terms of Madhya Pradesh Junior Service (Joint Qualifying) Examination Rules, 2013 whereby Computer Proficiency Certification Test (CPCT) score card was one of the essential qualifications, and that Rule 3.9(7)(c) and (d) of Computer Proficiency Certification Test Rule Book for Examinees prohibits consideration of multiple score cards of single candidate.

(5) Learned counsel for the appellant reiterates the grounds raised as was raised in the writ petition that it is impermissible for the respondent to reject his candidature in absence of any rule to the contrary. It is urged that the recruitment rules, viz Excise (Subordinate Class III) Ministerial Service Recruitment Rules, 1983, nowhere lay down that the incumbent shall possess the CPCT score card. In absence whereof, the rejection of petitioner's candidature is de hors the 5 WA.883.2018 Rules.
