1. Petitioner impugns order dated 13.12.2018 whereby the Appellate Court has imposed a pre condition of deposit of the entire compensation amount as a condition for grant of bail.
2. Respondent had filed a complaint under Section 138 of the Negotiable Instruments Act alleging that a cheque in the sum of Rs.6 lakhs was signed by the petitioner as also by her husband towards repayment of the earnest money given for the purchase of a property.
3. Petitioner has been convicted of the said offence by judgment dated 04.09.2018 and sentenced by order dated 13.11.2018 inter-alia CRL.REV.P.175/2019 1 to pay compensation equivalent to the cheque amount i.e. Rs.6 lakhs.
4. Learned counsel for the petitioner after some arguments seeks leave to withdraw the petition, however, submits that some more time may be granted to deposit the amount.
5. Keeping in view the facts and circumstances, the petition is dismissed as withdrawn, however, petitioner is granted further four weeks time to comply with the order of the Appellate Court and deposit the compensation amount of Rs.6 lakhs.
