Learned advocate for the applicant seeks permission to withdraw  this application with a liberty to file the discharge application before the  trial Court. Applicant has already filed the discharge application before  the   trial   Court.   Permission   as   sought   for   is   granted.   Petition   stands  disposed of as withdrawn.

3. It   is   clarified   that   the   trial   Court   shall   decide   the   discharge  application on its own merits and without in any way being influenced  by the present order.
