2. The case of the prosecution is that the accused VV K Sharma was posted as AO Song and Drama Division Bhopal and was on duty at the Headquarters in Delhi. The Song and Drama Division Headquarters at Delhi placed an order to M/s HP India sales Private Ltd to supply a computer system containing one computer (HP) with TFT monitor and one multi functional printer (Rico) for use at the Regional Office of the Song and Drama Divsion at Bhopal. The equipments were delivered at the Headquarters in Delhi by M/s Shiva Systems, Krishnanagar, Delhi which was the authorized agents of M/s HP India Sales Pvt. Ltd. The accused contacted M/s Trackon Private Ltd, New Delhi, the authorized courier agency by the suppliers for sending the three equipments namely the computer, monitor and multi functional printer to Bhopal by courier service. It is alleged against the accused that he prepared the gate pass on 02.06.2011, for taking out the three equipments in three different boxes and handed the gate pass to M/s Track on Limited and got a receipt indicating that the said courier agency received the 3 equipments.

informed on 17.08.2011, that they had sent the multi-functional printer to Bhopal office while the computer and the monitor was sent to the residence of the accused Shri V.V.K.Sharma at H.No. 240 B, Pocket-F, Dilshad Garden, New Delhi, as it was directed to be done so by the accused Sharma. A letter was also received from M/s Shiva Systems, the supplier of the equipment that the accused Shri VV K Sharma had asked the supplier to deliver the multi functional printer to the Bhopal office and to deliver the computer and the monitor to his residence. Accordingly, these two equipments were delivered at residence of accused by the concerned courier agency on the direction of the supplier who had on the specific order of accused asked these 2 computer equipment to be delivered at accused residence. Accordingly, it was alleged that government equipment worth ₹33,000 has been stolen by Sh.V.V.K.Sharma and authorized and illegally kept in his residence.

GARG GARG 16:24:27 2024.09.19 +0530 the Deputy Director at Regional Office, Bhopal sent a requisition to HP India sales Private Ltd. to supply 1HP desktop computer, monitor and the same was requested to be delivered at the Office of the Song and Drama Division. Delhi and the bill was required to be sent to the Deputy Director Songs and Drama Division, Bhopal for payment. On the same day, another acquisition was sent for buying a multi functional printer and the same was requested to be delivered at the office of the Song and Drama Division. Delhi and the bill was required to be sent to the Deputy Director Songs and Drama Division Bhopal for payment. The above said articles were sent to the Song and Drama Division, Delhi by M/s Shiva Systems.

21. PW1, the complainant had requested NK Jain, copyist at the Bhopal Office to provide information whether the multi functional printer, computer and the TFT monitor were received by the Bhopal office or not vide a letter dated 16.8.2011 which is Ex.PW1/N.
