Apprehending arrest in Crime No.936 of 2023 of Kondotty Police Station, Malappuram, registered for offences punishable under Section 420 of the Indian Penal Code, 1860 and Sections 4 and 20 of the Telegraphs Act and Sections 3 and 6 of Indian Wireless Telegraphy Act, 1993, the petitioner/ accused No.1, has filed this petition seeking pre-arrest bail.
2. The prosecution case is that on the basis of the source information, Kondotty Police Station searched the building of one Haneefa situated at Kizhisseri on 3.8.2023 at 5.30 p.m. and found that the accused had been running a parallel telephone exchange and thereby, accused is said to have committed the aforesaid offences.
3. The learned counsel appearing for the petitioner and the learned Public Prosecutor were heard.
4. Considering the allegations against the petitioner that he was allegedly conducting a parallel telephone exchange, it cannot be said that the offences are not attracted. Therefore, I am not inclined to grant anticipatory bail as it will adversely affect a proper investigation. Accordingly, the anticipatory bail application is dismissed, and the following directions are issued:-
