In the reply filed by the respondents, it is stated that in view of the Circular dated 16.12.2009, the petitioner is not entitled for the amount claimed for surgery of Cochlear Implant.
In view of the fact that the said circular was made applicable w.e.f. 16.12.2009 and the petitioner is claiming the amount of expenses occurred prior to the said date, therefore, the denial of amount to the petitioner under the circular dated 16.12.2009 is not sustainable in law.
