35. Mr.Joshi relied on the affidavit of evidence of RW2 Ramashankar S. Maurya (exhibit 81) and referred to it on the point of disqualification. He referred to the written statement (exh. 2) filed by Respondent No.1 Shri Gopal Shetty, wherein he has denied all the allegations in respect of corrupt practice in his written statement.
36. While replying on the point of non-disclosure of the assets of M/s.Jyoti Construction, which is a partnership firm of the wife of Respondent No.1, he pointed out the averments made in paragraphs 23 to 25 of his written statement. He argued that M/s.Jyoti Construction has carried out only one construction of Kandivali Siddheshwar CHS Ltd. On CTS Nos.36, 36(1) to 36(12) at Poisar, Kandivali, Mumbai and the said project was complete in 2005 and thereafter, no scheme of development or construction was taken up by M/s.Jyoti Construction. In the year 2014, the said partnership was not in existence. Thus, M/s.Jyoti Construction was not having any asset in its name, at the relevant time. He pointed out exhibit 50 and exhibit 51 and has submitted that exh. 51 is the affidavit of evidence of Respondent No.1. He pointed out ep.1.2014(J).doc that alongwith his affidavit in chief, he has produced annexure 1, which is also read as part of his evidence.
